Colorado State Patrol member Brandon Stevens was arrested on Saturday on suspicion of domestic violence and second-degree assault. He was arrested at his residence without incident and immediately placed on administrative leave, according to the Colorado State Patrol.
Stevens joined the state patrol in April 2023 and graduated from the academy in the fall. He has worked in the Alamosa Troop Office since graduating.
According to the Colorado Revised Statutes, assault in the second degree is class 6 felony if assault “is committed under circumstances where the act causing the injury is performed upon a sudden heat of passion, caused by a serious and highly provoking act of the intended victim, affecting the person causing the injury sufficiently to excite an irresistible passion in a reasonable person, and without an interval between the provocation and the injury sufficient for the voice of reason and humanity to be heard.”
Otherwise, if assault is committed without the prior circumstance it is class 4 felony. Class 6 felonies are the least serious felonies one can be charged with. Class 4 felonies are more serious and carry a much longer maximum sentencing.
Colorado has a mandatory arrest law for those suspected of committing acts of domestic violence.
